These General Terms and Conditions (GTC) govern the legal relationship between visitors and brut Wien Koproduktionshaus GmbH (subsequently referred to as brut).
The scope of the GTC includes the sale of tickets to the events offered on www.brut-wien.at as well as events for which tickets are purchased at the brut box office.
Visitors are subject to the house rules of brut Wien Koproduktionshaus GmbH.
The ticket order of the visitors is a binding offer. brut is free to either accept offers on www.brut-wien.at/tickets within 14 days of receipt of a ticket order or to reject it by sending a corresponding statement to the orderer. In particular, in the event of price increases that have occurred in the meantime or any mistakes in programme folders, price lists, electronic publictaion or other documentation of brut. Any liability for such price increases or errors is excluded.
No money will be refunded for lost tickets. A return of the ticket (exchange or repurchase) is – with the exception of an event cancellation – not possible.
In case of passing on a ticket, it is incumbent on the preceding acquirer to transfer the general terms and conditions of brut to each further acquirer.
The sale of tickets for brut performances by third parties is not permitted!
The valid ticket must always be presented to the brut staff upon request.
In case of violations of the house rules, visitors with valid tickets can also be expelled from the performance. The purchase price will not be refunded in such cases.
All prices are quoted as "gross prices" (incl. VAT). Misprints and individual price changes remain reserved.
Reduced tickets can only be purchased by visitors if they can prove that they belong to one of the beneficiary groups.
There is no legal entitlement to discount tickets, to specific tickets or ticket categories, or to the reservation of one or more tickets. The discount cards are invalid without a photo ID that substantiates the beneficiary status. In the event of incorrect use of a ticket, the price difference can be demanded and the visitor expelled from the performance. In the latter case, the purchase price of the ticket will not be refunded in part or in full.
Visitors are not permitted to record events or parts thereof on sound and/or image media (photo, video, film, data storage).
At its events, brut records sound and images on an occasion-related basis for the purpose of documentation and (live) reporting. In the above sense, brut has a legitimate interest in these sound and image recordings, but the audience has a right of objection in accordance with Art 21 DSGVO. Even short-term postponements of the start of the performance do not allow the return of the ticket. It is the responsibility of the purchaser to inform himself/herself on the day of the performance about any changes to the start of the performance. If the performance is cancelled, a replacement performance may be offered. If this is not possible for programme-related or other reasons, brut will refund the ticket price only if less than half of the performance time has been shown at the time of cancellation.
Ticket returns are generally not possible.
A return or exchange of paid tickets is not possible. No compensation will be made for tickets that are not used or only partially used (e.g. due to late arrival) or for tickets that are lost in any way.
The liability of brut for ordinary negligence, compensation for consequential damage, financial loss, loss of profit and damage from third-party claims against visitors is excluded. The exclusion of liability for ordinary negligence does not apply to personal injury.
The place of fulfilment for all contractual items is Vienna. Austrian law shall apply to this contract. The District Court for Commercial Matters in Vienna (Bezirksgericht für Handelssachen Wien) is agreed to be the exclusively responsible court for disputes arising from orders placed with brut – insofar as this is legally permissible. Should individual provisions of these GTC contradict mandatory statutory provisions, the remaining provisions of these GTC shall nevertheless remain valid.
In the interest of a pleasant stay for all participants at events of Koproduktionshaus Wien GmbH (subsequently referred to as brut), we request that the following be respected.
Visitors of brut agree to the following general conditions of use.
All persons must comply with the instructions of the brut staff and the orders of the official supervisory authorities.
These general terms and conditions of use apply to all events organized by brut at brut nordwest (Nordwestbahnstraße 8-10, 1200 Vienna) as well as studio brut (Zieglergasse 25, 1070 Vienna) and at all venues where brut acts as organizer.
The provisions of the Wiener Veranstaltungsgesetz, LGBI. für Wien Nr. 53/2020 i. d. g. F. shall apply to all events, directly if the events are subject to the Vienna Events Act and correspondingly if the events are not subject to the Wiener Veranstaltungsgesetz but the application of the provisions of the Wiener Veranstaltungsgesetz is necessary for the safety of the participants of the event.
According to the Wiener Veranstaltungsgesetz Act § 27 para. 6, the surveillance authorities of the Vienna Provincial Police Directorate are entitled to expel persons from the event venue if the expulsion is necessary to maintain public order and safety or if the person violates the house and its rules. Disregard to comply with the removal order by the surveillance bodies of the Vienna Police Directorate constitutes an administrative offense.
Furthermore, the fire protection regulations in their current form are an integral part of these general conditions of use.
All visitors are required to contribute to the safety of events. In particular, the carrying of weapons of any kind, pyrotechnic products and other dangerous objects is prohibited.
In the event of an incident, the instructions of the staff must be followed.
Until further notice, visitors are permitted to stay in the event area with an admission ticket valid for the current day. Access to or stay in other rooms is not permitted.
In the event of ice and snow, only the cleaned and gritted paths may be used in the immediate outdoor area. No liability is assumed for walking on other paths.
Admission to evening events – with the exception of separately marked events – is open to anyone who has reached the age of 16 – provided that no other age information is given for the project.
In general, brut will be happy to answer any questions regarding age restrictions for individual productions.
Information on admission prices can be found on the brut homepage – www.brut-wien.at – or in the folder. When purchasing a ticket, contractual relations are exclusively between the ticket holder and the organizer. The organizer reserves the right to change the date and/or location of the performance or to cancel the performance.
If the performance is cancelled, a replacement performance may be offered. If this is not possible for programmatic or other reasons, brut will refund the ticket price only if less than half of the performance has been shown at the time of cancellation.
Admission discounts are granted in different ways. Information on the respective discounts can be found on the brut homepage (https://brut-wien.at/de/Tickets).
There is no right to late admission. Guests who arrive late may only be admitted to the event after the brut staff has given the appropriate clearance.
According to the Wiener Veranstaltungsgesetz, there is an obligation to hand over items that could be a barrier in the event of danger or fire. This includes handbags, briefcases, laptop bags, backpacks as well as luggage, coats, down jackets, umbrellas, walking sticks, skateboards, scooters and similiar things.
In case of dispute, the final decision will be made by the brut staff or the brut authorized representative on duty (usually referred to as evening service).
With the handing out of the wardrobe ticket, brut takes liability for intentional or gross negligent violation of the retention obligation by the wardrobe staff during the duration of the event.
Please inform the brut wardrobe staff separately about items worth €500 or more (e.g. laptops, musical instruments, cameras, etc.).
Items of any kind that are found during events should be handed in to the brut staff.
After the end of the event, found objects will be kept by brut.

Different closing hours may apply to events (please ask brut staff for details). In principle, brut complies to the night curfew of the City of Vienna (10pm). When the closing time is announced, the visitors have to leave the outside area/event rooms etc.

Its not permitted to bring animals, with the exception of guide dogs for the blind and partner dogs as defined in §32 of the Wiener Veranstaltungsgesetz.
At individual events, there may be a risk of damage to hearing and health due to high noise levels. If necessary, visitors can request suitable hearing protection from the brut staff / at the box office, which will be issued free of charge.
If stroboscopic effects are used in a performance, information will be put up on the hall door.
brut accepts no liability for any damage to hearing or health.
The domiciliary rights of brut are exercised by the responsible managing directors or, in their absence, transferred to the evening service on duty.
These managers are entitled, if necessary, to expel persons who disturb the course of events (e.g.: are impaired by alcohol, drugs or other intoxicants) or do not comply with the house rules in any other way. They may issue house bans or take other appropriate measures within the scope of the house rules.
In the event of expulsion from an event or the issuing of a house ban, there is no entitlement to replacement of the ticket price or other costs in connection with an event.
Any liability of brut for personal injuries suffered in brut is – unless further liability is prescribed by law – limited to such damages resulting from intentional acts or gross negligence of brut staff. Any liability of brut for damages caused to visitors by the fault of third parties is excluded.
The provisions of the Tabakkgesetz §22 of the Wiener Veranstaltungsgesetz apply. Smoking is generally prohibited in brut.
The distribution of printed matter or the sale of goods of any kind on the event premises is only permitted with the prior written consent of brut. The other organizer has to take care of all necessary official permits, is liable for the payment of all duties (e.g. taxes) and has to keep brut indemnifyed in this matter.
With the purchase of an admission ticket, the visitors undertake to comply with the COVID-19 preventive measures undertaken by brut (in particular proof of admission, contact tracing, obligation to wear a mask, seating regulations, etc.). These will be published according to the current regulations on the website of brut.
