## I. General terms of use of the website
By accessing and using the brut-wien.at website, visitors accept these terms and conditions without any limitations of any kind.
Access to the brut-wien.at website is therefore subject to these terms and conditions as well as all applicable laws. The brut-wien.at website contains information about events and activities organized by Koproduktionshaus Wien GmbH (hereinafter referred to as ‘brut’) and strives to keep this information as up-to-date as possible. Any information contained on this website is provided for informational purposes only. The information does not constitute a warranty of any kind.
brut reserves the right to make changes to dates and availability at any time without notice.
The colors displayed may differ from the actual colors depending on the monitor and screen resolution. Mistakes and typographical errors reserved.

## II. General terms and conditions of brut Wien Koproduktionshaus GmbH
These General Terms and Conditions (GTC) govern the legal relationship between visitors and brut Wien Koproduktionshaus GmbH (hereinafter referred to as ‘brut’).
The scope of these GTC covers the sale of tickets for events offered on www.brut-wien.at as well as events for which tickets are purchased at the brut box office.
Visitors are subject to the house rules (INSERT LINK) of brut Wien (Koproduktionshaus Wien GmbH).
### Conclusion of the contract
By purchasing a ticket, visitors accept both the house rules and the General Terms and Conditions of brut.
A visitor’s ticket order constitutes a binding offer. brut is free to either accept offers placed on www.brut-wien.at/tickets within 14 days of receiving a ticket order or to reject them by sending a corresponding notice to the purchaser. This applies in particular in the event of price increases that have occurred in the meantime or any errors due to mistakes in programme brochures, price lists, or other documentation from brut. This also applies to electronic publications. Any liability for such price increases or errors is excluded.
No refunds will be issued for lost tickets. Tickets cannot be returned (exchanged or repurchased) – except in the event of a cancelled performance.
In the event that a ticket is transferred to another person, it is the responsibility of the previous purchaser to ensure that each subsequent purchaser is made aware of brut’s Terms and Conditions.
The offering for sale or sale of tickets for brut performances by third parties is not permitted!
A valid ticket must be always presented to brut staff upon request at all times.
A ticket is invalid without the tear-off stub.
In the event of violations of the house rules, even visitors with valid tickets may be ejected from the performance. In such cases, the purchase price will not be refunded.
When tickets are purchased through our online store, your data is stored in brut’s ticketing system. The lawful processing of personal data takes place within the framework of the contractual relationship brut has with the purchaser. ### Prices
All prices listed are “gross prices” (including sales tax). brut reserves the right to correct printing errors and make individual price changes.
### Discounts
Visitors may purchase discounted tickets only if they can provide proof that they belong to one of the eligible groups.
There is no legal entitlement to discounted tickets, to specific tickets or ticket categories, or to the reservation of one or more tickets. Discounted tickets are invalid without a photo ID proving eligibility for the discount. If a ticket is used improperly, the difference in price may be charged, and/or the visitor may be removed from the performance. In the latter case, the ticket price will not be refunded, either in part or in full.
### Photography, film, video, and audio recordings
Visitors are not permitted to record events or parts thereof on audio and/or visual media (photographs, video, film, data storage devices).
At its events, brut makes audio and video recordings as needed for the purposes of documentation and (live) reporting. In this context, brut has a legitimate interest in these audio and video recordings; however, the audience has the right to object pursuant to Article 21 DSGVO. ### Cast or programme changes
brut reserves the right to make changes to the cast or programme. Such changes do not entitle to a refund or exchange of tickets.
Even last-minute changes to the start time of a performance do not entitle to a refund. It is the purchaser’s responsibility to check for any changes to the start time on the day of the performance. If a performance is cancelled, a replacement performance may be offered. If this is not possible for scheduling or other reasons, brut will refund the ticket price only if, at the time of cancellation, less than half of the performance’s running time has been presented.
### Right of return
Ticket returns are generally not permitted.
Paid tickets cannot be returned or exchanged. No refunds will be issued for tickets that were not used or were only partially used (e.g., due to arriving late) or for tickets lost in any way.
### Liability
The liability of brut for slight negligence, compensation for consequential damages, financial losses, lost profits, and damages arising from third-party claims against visitors is excluded. The exclusion of liability for slight negligence does not apply to personal injury.
### Place of performance, governing law, and jurisdiction
The place of performance for all contractual matters is Vienna. This contract is governed by Austrian law. The District Court for Commercial Matters (Bezirksgericht für Handelssachen Wien) in Vienna is agreed upon as the exclusive court of jurisdiction for disputes arising from orders placed with brut – to the extent permitted by law. Should individual provisions of these Terms and Conditions conflict with mandatory statutory provisions, the remaining provisions of these Terms and Conditions shall nevertheless remain valid.

## IV. General terms of use
To ensure that everyone has a pleasant experience at events organized by Koproduktionshaus Wien GmbH (hereinafter referred to as ‘brut’), please observe the following.
Visitors to brut agree to the following general terms of use.
All persons must comply with the instructions of brut staff and the instructions of the relevant regulatory authorities.
### 1. Venue
These General Terms of Use apply to all brut events at brut nordwest (Nordwestbahnstraße 8–10, 1200 Vienna) and studio brut (Zieglergasse 25, 1070 Vienna), as well as at all venues where brut acts as the organizer.
### 2. Legal
The provisions of the Vienna Events Act (Wiener Veranstaltungsgesetz, LGBI. for Vienna No. 53/2020, as amended) apply to all events: directly, if the events are subject to the Vienna Events Act; and by analogy, if the events are not subject to the Vienna Events Act but the application of the provisions of the Vienna Event Act is necessary for the safety of event participants.
According to the Wiener Veranstaltungsgesetz Act § 27 para. 6, the surveillance authorities of the Vienna Provincial Police Directorate are entitled to expel persons from the event venue if the expulsion is necessary to maintain public order and safety or if the person violates the house and its rules. Disregard to comply with the removal order by the surveillance bodies of the Vienna Police Directorate constitutes an administrative offense.
Furthermore, the fire safety regulations in their current form are an integral part of these general terms of use.
### 3. Safety
All visitors are required to contribute to safety at events. In particular, carrying weapons of any kind, pyrotechnic products, and other dangerous objects is prohibited.
In the event of an incident, the instructions of the staff must be followed without exception.
### 4. Admission, stay, and outdoor areas
The use of cell phones during the performance is not permitted.
Visitors are permitted to remain in the event area until further notice only with a valid ticket for that day. Access to or presence in other rooms is not permitted.
In the event of ice or snow, visitors may only use the cleared and sanded paths in the immediate outdoor area. No liability is assumed for use of other paths.
### 5. Children
Admission to evening events is restricted to those who has not reached the age of 16 – with the exception of events specifically marked otherwise – provided that no other age information is given for the project.
In general, brut is happy to answer any questions regarding the age restrictions for individual productions.
### 6. Admission, cancellation, discounts
Information on admission prices is available on the brut website – www.brut-wien.at – or in the brochure. When purchasing a ticket, a contractual relationship is established exclusively between the ticket holder and the organizer. The organizer reserves the right to reschedule the date and/or venue of the event or to cancel the event.
If a performance is cancelled, a replacement performance may be offered. If this is not possible for scheduling or other reasons, brut will refund the admission price only if, at the time of cancellation, less than half of the performance’s running time has been presented.
Admission discounts are granted on a case-by-case basis. Information on the respective discounts is available on the brut website (https://brut-wien.at/de/Tickets).
### 7. Admission for latecomers
There is no right to late admission. Latecomers may only be admitted to the event upon approval by the brut audience services staff.
### 8. Wardrobe
According to the Vienna Event Venues Act, there is an obligation to check in items that could pose an obstruction in the event of an emergency or fire. These include, among other things, handbags, briefcases, laptop bags, backpacks, as well as luggage, coats, down jackets, umbrellas, walking sticks, skateboards, scooters, and similar items.
In case of a dispute, the final decision rests with the brut staff or the authorized representative on duty at brut (usually referred to as evening service).
Upon issuance of the wardrobe ticket, brut assumes liability for any intentional or grossly negligent breach of the duty of care by the coat check staff during the duration of the event.
Please inform the brut wardrobe staff separately regarding items to be checked in that are valued at €500 or more (e.g., laptops, musical instruments, cameras, etc.).
### 9. Lost and found
Please turn in any items found at events to the brut staff.
After the event ends, found items will be held by brut.

### 10. Closing time at events
Different closing times may apply to events (please ask brut staff for details). In general, brut adheres to the City of Vienna’s nighttime curfew (10:00 p.m.). When the closing time is announced, visitors must leave the outdoor area, event spaces, etc.
### 11. Photography, film, video, and audio recordings
Visitors are not permitted to record events or parts thereof on audio and/or visual media (photos, video, film, data storage devices).
At its events, brut makes audio and video recordings as needed for the purposes of documentation and (live) reporting. In this context, brut has a legitimate interest in these audio and video recordings. The audience has the right to object pursuant to Article 21 DSGVO. ### 12. Animals
Bringing animals into the venue is prohibited, with the exception of guide dogs and service dogs as defined in §32 of the Vienna Event Act (Wiener Veranstaltungsgesetz).
### 13. Sound levels / Stroboscopic effects
At certain events, high sound levels may pose a risk of hearing damage and other health hazards. Visitors may, if necessary, request appropriate hearing protection from the brut staff or at the box office, which will be provided free of charge.
If strobe effects are used during a performance, this will be indicated by a notice posted on the auditorium door.
brut assumes no liability for any hearing damage or health issues.
### 14. Disruption of events, premises, and bans from the premises
brut’s right to enforce house rules is exercised by the responsible managing directors or, in their absence, delegated to the evening service on duty.
These managers are authorized, if necessary, to expel from the premises any persons who disrupt the course of events (e.g., those under the influence of alcohol, drugs, or other intoxicating substances) or who otherwise fail to comply with the house rules. They may issue bans from the premises or take other appropriate measures within the scope of the house rules.
In the event of expulsion from an event or the issuance of a ban from the premises, there is no entitlement to a refund of the ticket price or other costs associated with an event.
### 15. Liability for personal injury
brut’s liability for personal injury sustained at brut is – unless further liability is required by law – limited to damages resulting from intentional acts or gross negligence on the part of brut staff.
brut assumes no liability whatsoever for damages inflicted on visitors through the fault of third parties.
### 16. Smoking ban
The provisions of Tabakgesetz §22 of the Wiener Veranstaltungsgesetz apply. Smoking is generally prohibited at brut.
### 17. Distribution of flyers, sales
The distribution of printed materials or the sale of goods of any kind on the event premises is permitted only with prior written authorization from brut. The other organizer must obtain all necessary official permits, is liable for the payment of all fees (e.g., taxes), and must indemnify and hold brut harmless in this regard.
